These Terms and Conditions ("Terms") govern your use of the website and services provided by Ace Blueprinters of Brevard, Inc. ("we," "us," or "our"). By accessing our website, uploading files, or placing an order for printing services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Services Provided
Ace Blueprinters of Brevard, Inc. provides reprographic services, including but not limited to large-format blueprinting, digital scanning, color plotting, and specification copying. We reserve the right to modify, suspend, or discontinue any part of our services at any time without notice.
2. Intellectual Property and Copyright Warranties
This is a critical section for our customers regarding architectural and engineering drawings:
- User Warranty: By submitting files, plans, drawings, or documents to us for printing or scanning, you represent and warrant that you are the owner of the copyright or have the express permission of the copyright owner to reproduce the content.
- Indemnification: You agree to indemnify, defend, and hold harmless Ace Blueprinters of Brevard, Inc. from any and all claims, damages, or liabilities (including legal fees) arising out of any alleged copyright infringement or unauthorized use of proprietary data resulting from your orders.
- Right to Refuse: We reserve the right to refuse to print or reproduce any material that we believe, in our sole discretion, may violate copyright laws or that is unlawful, offensive, or abusive.
3. File Accuracy and Print Quality
- "As Submitted": We print files exactly as they are submitted. We are not responsible for errors in the original digital file, including spelling errors, incorrect dimensions, or design flaws.
- Resolution: It is your responsibility to ensure that uploaded files have a sufficient resolution for the desired print size. We are not responsible for "pixelation" or blurriness caused by low-resolution source files.
- Color Matching: Please note that the colors on your computer screen may differ slightly from the final printed product due to calibration differences between monitors and printers. We do not guarantee an exact color match unless a hard-copy proof is requested and approved prior to the full production run.
4. Orders and Payment
- Pricing: Prices are subject to change without notice. Quotes are valid for 30 days unless otherwise noted.
- Payment: Payment is due at the time of order unless you have an established commercial credit account with us. We accept major credit cards, checks, and cash.
- Cancellations: Orders enter our production queue immediately. If you need to cancel an order, you must contact us immediately. If production has already begun, you may be responsible for the cost of materials and labor used up to that point.
5. Delivery and Turnaround
- Turnaround Times: Estimated turnaround times are estimates only and are not guaranteed. While we strive to meet all deadlines, delays may occur due to equipment maintenance, high volume, or unforeseen circumstances.
- Shipping: We are not liable for delays caused by third-party shipping carriers (e.g., UPS, FedEx) once the package leaves our facility.
- Order Pickup: Orders designated for pickup must be collected within 30 days. Orders left longer than 30 days may be discarded or recycled, and you remain liable for the cost of the order.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Ace Blueprinters of Brevard, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any errors or omissions in any content or prints;
- Any unauthorized access to our servers or personal information stored therein.
Our total liability for any claim arising out of your use of the services is limited to the amount you paid us for the specific service giving rise to the claim.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Brevard County, Florida.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
